Terms of Service Agreement

It is the goal of us here at Savy2k to provide our clients with the very best service we can for the very best price we can. As a result we feel it is important to make it clear as possible what you can expect from Savy2k and what we expect from you. By it's very nature; the Internet is a constant state of change. New capabilities are always in the making and that in and of it's self poses both opportunity and risk. The fact that we can now connect to computers around the world makes it possible for the public in general to have access to information that was only available to Universities and Government Agencies just a few years ago.

The Internet has brought new meaning to the word "Shopping". Anyone with a computer and a credit card can buy almost anything from almost anyone. Security is constantly being improved and the Internet is fast becoming the tool of choice for the shopping public. Whether you want to find out the price and horsepower of your favorite vehicle or just catch up on the news of the day, the Internet is there with what you want just a click away.

The Internet is a double-edged sword though. Unscrupulous people and organizations use the Internet to spread hurtful propaganda and even virus' that can destroy many hours of work. As a result, it up to all of us to take measures to protect ourselves from these hazards while we enjoy this amazing informational tool. Please read this Service Agreement carefully and practice good Netizenship.

1. The due date for payment is the 28th of each month. The client must pay each month in advance. If the payment isn't received by the due date, a late fee of $3.00 will be charged. If the payment isn't received by the 10st of the month, service will be suspended and a "setup fee" will be required. Setup fees and payments are not refundable. However, Savy2k may at the management's discretion, refund part of an Annual plan if sufficient notice is given and there is a good reason for the premature cancellation. The client will be charged the monthly rate for the portion of the Annual plan that was used. All specially priced subscriptions are subject to full regular price if the payments are not kept current. That means that the payments must be in our office no later than the 28th of the month it is due which is the month preceding the month of service.

2. A client may put his/her account on hold if the following conditions are met. (1) The account must be brought up to current status; (2) A $10 holding fee may be charged for holding the account. The account will automatically be held for 3 months then the client must contact Savy2k if it is to be held longer.

3. There will be a minimum fee of $25 for any checks or any other payment device (i.e.: credit card payment request) that are returned unpaid. If the due date for payment has passed, other fees may apply (i.e.: reconnect fee of $10 if the account is discontinued). If it becomes necessary for us to refer the account to a collection agency, a $25 administrative fee will be added to the closing statement. We don't like these fees anymore than you do, but they cost us so we must pass the expense on to the person responsible.

4. The term "unlimited access", does not mean unlimited connections. Each client is allowed (1) one connection at a time, if more than one connection is detected, all connections to that account will be terminated and the client of record will be notified via email. If is continues to happen, the account may be permanently terminated. We have plans for multiple connections. If you have several computers in one house, we recommend that you get a proxy server. We can help you with that if you need it.

5. The client may not resale our services without our permission.

6. It is up to the client to provide the client hardware and software to access the net. Savy2k will provide reasonable technical support via telephone but it is up to the client to maintain his/her equipment.

7. All service plans are automatically renewable. The client may cancel the service at any time by notifying Savy2k in writing including the date, the cancellation request and the signature of the client of record. The service will be terminated at the end of the current billing cycle. It is up to the client to make arrangements for email. Savy2k is not responsible for lost or undeliverable E-mail after the service has been terminated. However, we will forward email for a small fee. Savy2k, reserves the right to discontinue service with anyone if the management of Savy2k believes that continued service with the account holder is harmful to the good will of Savy2k or any of its clients or business associates.

8. The client must remember that Savy2k only provides access to the Internet. And all merchandise, information and services offered or made available or accessible on the Internet are offered or made available by third parties that are not affiliated with Savy2k. Savy2k makes no express or implied warranties, representations or endorsements (including without limitation warranties of title or noninfringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to any merchandise, information or service provided through the Internet. Savy2k shall not be liable for any cost or damage arising either directly or indirectly from any such transaction. It is solely the client's responsibility.

9. The client assumes full responsibility for the use of the service whether it is by the client of record or anyone the client allows to use the service. It is up to the client to keep the password and username safe from unauthorized use. Remember that the Internet contains material that some people would find objectionable. We do not control the Internet and we do not censor the material available to our clients.

10. If at any time the client feels the need to change his/her password, he/she may do so by calling our office and choosing another password. We will ask some questions to verify that the person requestion the change is the client on record. If the password is lost the network administrator may require the client to prove his/her identity by coming by the office and showing legal identification or mailing a signed and dated request for the password to our office at 2178 Beechwood Ct Hanford CA 93230.

11. Any client using this service in any capacity in which any federal, state, or local law is being violated is subject to immediate termination of service and possible legal action. Savy2k will cooperate with law enforcement agencies in the investigation of any illegal activities to the extent the law requires. It does not behoove our clients or any of us that work here for someone to risk our jobs by conducting illegal activities using our help. Netiquette Netiquette is just being responsible on the net. Show others respect. There are some links to sources of netiquette skills on our home page. We reserve the right to interrupt or permanently stop service to any client we believe is acting in such a way as to harm the reputation of Savy2k.

The following items are not acceptable and are grounds for termination. 1. Duplicative and unsolicited email for commercial or any other use. 2. The willful spread of virus' or other harmful or illegal code. 3. Any effort to "hack" into other computers or conducting any form of illegal activity.

Privacy Statement

One of the ways that ISP's make money is to sell some of the information that they get from their clients to marketing company's. As a result, more and more people are concerned about how the information they give is used and who is going to get it. Well, I can tell you that most ISP's are conscientious about privacy and don't sell personal information to marketing companies. From the inception of our company, all of us at Savy2K. have agreed to not release any personal information to anyone unless they have a court order requiring us to do so by law. We may use the information in statistical form [example; 25% of our customers are under the age of 25] this helps with marketing and doesn't place your privacy at risk. In any case, we want you to know that we will never do anything that will threaten your privacy.
